Presiden kita tidak punya Hak Prerogative

Prerogatif berasal dari bahasa latin praerogativa ( dipilih sebagai yang paling dahulu memberi suara), praerogativus (diminta sebagai yangpertama memberi suara), praerogare ( diminta sebelum meminta yang lain).

Pertama saya ingin mengutip pendapat Hendarmin Ranadireksa,sebagai berikut : “Substansi grasi, amnesti, abolisi dan rehabilitasi adalahpengakuan atas keterbatasan manusia sebagai makhluk yang tidak sempurna.Manusia bisa khilaf, bahwa kesalahan adalah fitrah manusia, tidak terkecuali dalammemutus perkara. Yudikatif… sebagaimana halnya Legislatif dan Eksekutifberada di wilayah ‘might be wrong’. Penggunaan hak prerogatif oleh kepala negara (wilayah can do no wrong) hanyadalam kondisi teramat khusus. Hak prerogatif dalam bidang hukum adalah katup pengaman yang disediakan negara dalam bidang hukum’.

Sekarang, kita telaah, bahwa didalam UUD 1945 Dalam Satu Naskah, tidak memuat satu pasalpun yang menjelaskan  Peran Presiden selaku kepala Negara  yang wilayahnya Can Do No Wrong itu. Artinya hak-hak yang melekat pada dirinya tidak ada.Karena itu versi UUD 1945 Dalam satu Naskah, haq prerogative Presiden tsb diejlaskan seperti ini :

(1) Presiden memberi grasi dan rehabilitasi dengan memperhatikanpertimbangan Mahkamah Agung. *)

(2) Presiden memberi amnesti dan abolisi dengan memperhatikan…pertimbanganDewan Perwakilan Rakyat. *)

UUD yangkita miliki ini sungguh sangat Rancu dan produknya selalu akan menuai Kontoversi, seperti  kasus grasi untuk Syaukani, samasekali TIDAK bersifat sebagai “katup pengaman” karena mengusik nuran ikeadilan publik. Ini FATAL.

How important Religion for Indonesian

According to a 2000 census, almost 88% of Indonesians declared Islam as their religion, firmly consolidating the country’s status as the most populous Muslim-majority nation in the world. While 9% are Christian, 2% Hindu and 1% Buddhist.

When I was small I was often taught, even told, to learn by heart concerning the Pillars of Faith/Belief and the Pillars of Islam. The Pillars of Faith/Belief such as Belief in God, in the Prophets before the Prophet Muhammad God bless him, the Sacred Books before the Qur’an, Belief in Angels, and Belief in Divine Decree together with Belief in the Day of Judgment.

This Dogma can easily be explained authentically like the verse from Al Qur’an, in particular a verse from Al Hajj as follows “ya ayuhannasu ittaku robbakum” which means “Oh! Humankind be devout to (worship) your Gods”. I take the word robbakum to mean God. The God of Islam is Allah, The Hindu God is Sangyang Widiwase, The Jewish God is Adonai, and the Christian God is Allah (but read Alah).

In connection with Christmas, the Islamic Community almost throughout the world officially holds fast to the decrees of the Religious Teachers that to greet a person with “Merry Christmas” fits in with our tenets of tolerance and acceptance of other’s beliefs. It is a question of the attitude to a friend, or tolerance between religious communities, that we are able to participate in the Christmas festivities without it conflicting with our beliefs.

ABC TV Australia in a programme leading up to Christmas featured a report from Jakarta. This programme did indeed attract my attention because it reported on how Christmas was received and welcomed in Jakarta Malls. What touched me deeply was when a mother wearing a head scarf (jilbab) made the statement that she was very happy with Malls which were decorated with Christmas decorations (in the traditional Christmas way). There were Christmas Trees, Santa Claus, snow with all the other things we see which are associated with Christmas. The rhythm and tunes of the music are what is associated with Christmas. White Christmas. The shop assistants wore clothing of various colors such as Santa wears together with the distinctive hat.

It is my impression that when Australians see this program their opinion will change little by little. In the minds of some westerners, Islam is regarded as very hard, cruel or even barbaric such as the way they regard Amrozi and his associates who murdered hundreds of innocent people in the Bali bombings.

The attitude of the lady wearing her jilbab represents indeed the attitude of the modern world who cannot deny that the existence of differences is a certainty. The Pillar of Belief guides us to believe and have faith in the sacred texts of the Al Qur’an and to believe in the Prophets before Muhammad. We can show our appreciation to that mother wearing her jilbab, and be indeed proud of the local wisdom which indeed is inherent in our culture.

Let us think about the positioning of Borobudur (Buddhist) and Prambanan (Hindu) temples they are not too far from each other. The significance of this is that Buddhists and Hindus could live close to one another in harmony at that time. It also represents the rise and fall of powers, and war fare between kingdoms.

Finally I wish to quote again from Al Qur’an “I created the Nations and the Tribes so that you can all get to know one another. And in my eyes they are the most pious and devout”.

But we have a long way to go until we have reached tolerance. Western influences deemed by some authorities as anti-Islam was the reason why Lady Gaga was denied permission in Indonesia. The reason for her cancellation, authorities argued, is that she resembled “a devil worshiper.” Maybe if she dressed up as Santa’s helper, she might have been welcomed!

Adzan and False Rhythm

An European friend of mine, The G. Wagner, who have been long stay living with Indonesian neighborhood in the north of Bandung, frustrating with was very high noisy volume loud speakers, bad sound system and also almost more than 5 times a day. This coming from the Mosque near by his house.

Moslem have obligation to perform at least five times a day to pray, which are at around 4.30 am, 1200am, 03.30am 17.50 pm and 1900pm. So almost every mosque here utters called Adzan (Pray Call) as high as possible with the assumption can be heard by every moslem elsewhere. Of course there is not every mosque can prepare someone who has a good voice and sing beautiful adzan song , then anyone can do that to sing the adzan.

“Look at that Ali, if only five times a day and each only five minutes that was fine. But near my house people call for pray at 02.30 am with high volume. And what another worst were if early in the morning and in the late afternoon, the young kids using high mosque microphone and sing very bad song, no good tune, no melody and very bad voices as well, and that was terrible thing”, Wagner complaining. “For me that was not expressing praise to the God but that was humiliating God”, he added.

Wagner measured on how the people do in the church, but here in Indonesia since it is praising to the God the ability to sing does not important, but people accepted it.

Although vice President Budiono in his address to Board of Indonesia Mosque Meeting, implied that adzan was so nice to hear in softly voice and from far away, he wanted to regulate.

But, this is in Jakarta, a Dutch guy, who lived in an apartment , complained to imam about the call of prayer, “Can you keep the noise down!” the imam said you need to respect local customs, and if the Dutch man didn’t like it, He should move. The imam could have got angry and told the locals and had the Dutch man raced out of town. Instead, He didn’t get angry and told the man He should find a quiet apartment.

Ketika Tuhan Tidak Berpihak

Makin yakin, kalau Tuhan itu tidak berpihak kepada siapapun!. Coba saja renungkan, sudah berapa tahun Perang Israel dan Palestina itu berlangsung dan berapa milyar orang, baik orang islam, orang Kristen dan bahkan orang Yahudi, yang berdoa, supaya tidak terjadi peperangan antara kedua bangsa itu. Tak ada hasilnya, malahan sebaliknya di bulan ramadhan ini, korban makin banyak di antara kedua belah pihak akibat perang yang samakin brutal. Saya sahid (menyaksikan) di bulan yang makbul segala doa itu (Bulan Ramdhan), hanya menjadi keyakinan yang mempercayainya.

Lantas, dimana sebenarnya posisi Tuhan?

Baik, kita kupas dari dua kitab suci, yaitu al-quran dan bible. Lupa ayat/suratnya, tetapi bunyinya ; “faanjilu minas samawati maan, faahroja bihi samarat rizkon”, kira-kira arti bebasnya begini : “aku turunkan hujan dari langit itu hujan, dan aku keluarkan dari perut bumi itu buah2an, rizki untuk kalian”.

Nah rizki itu, untuk siapa saja, baik yang beriman maupun yang kufur. Diberi oleh Tuhan, tanpa syarat apapun, seperti harus beriman dan bertaqwa.

Dalam Bible, seperti tertulis dalam Matius 5:44, “He (God) causes his sun to rise on the evil and the good, and he sends rain on the righteous and the unrighteous”,

Kesimpulan dari kedua pandangan kitab suci itu, menurut hemat saya bahwa “sesungguhnya Tuhan tidak berpihak kepada siapapun”.

Tanpa Syaithon Inflasi Rate Sangat Tinggi

Sudah bukan rahasia umum, kalau bulan suci ramadhan, adalah bulan di mana syaitan-syaitan itu sedang di belunggu. Dalam pemahaman awam, maka syaitan-syaitan itu tidak berdaya lagi menggoda manusia-manusia terutama yang sedang berpuasa.

Syaitan adalah sosok makhluk, yang selalu di tuding dan di kambing hitamkan ketika sosok makhluk manusia melakukan kekeliruan.

Nah bagaimana wujud manusia yang tanpa syaitan-syaitan si bulan Ramadhan itu?

Kondisi umatnya saat berbuka puasa, penuh dengan banyak jenis makanan dan minuman. Saat maghrib dikumandangkan, sudah tersaji rapi di atas meja makan,   lebih dari satu macam minuman; Ada teh manis, kolak, jus buah dll. Bahkan, beberapa jam sebelum azan tiba sudah dipersiapkan berbagai macam aneka hidangan yang siap untuk disantap saat berbuka tiba.

Di ujung ramadhan, membeli baju baru dan mudik ke kampong dengan motor baru segala. Show off.

Sungguh berbeda dengan perilaku konsumsi yang dicontohkan oleh nabi Muhammad saw. Dalam riwayat hadis dijelaskan bahwa nabi berbuka puasa dengan kurma dan air. Jarang kita mendengar atau mendapatkan riwayat yang menjelaskan bahwa beliau shollallahu alayhi wa sallam mengonsumsi banyak makanan. Hal ini menunjukkan kesederhanaan dan perilaku konsumsi yang baik dan seharusnya menjadi suri tauladan buat kita umatnya.

Tanpa syetan inflasi rate kita justru sangat tinggi.

Israel vs Palestine – Syurga vs Neraka

Tiap menit kita disuguhkan up date berita dari medan pertempuran antara Israel dan Palestina. Sekarang Gaza sedang menjadi high light topic, karena di gempur bom Israel dan ratusan warga palestina yang tidak berdosa meninggal karena korban pembomban Isreal. Begitu juga sebaliknya, mungkin pihak Israelpun tentu banyak korban warga civilnya.

Tak habis pikir. Aneh sekali, karena bunuh membunuh itu telah lama berlangsung dan tak henti-hentinya.

Suatu hari saya berjalan-jalan di pusat kota Melbourne Australia. Di temui ada dua orang anak muda, yang sedang berciuman, duduk di kursi yang disediakan pemerintah kota, di sisi trotoar tempat orang berjalan kaki. Karena pertama kali saya melihat adegan seperti itu secara live, jadi saya menikmatinya, sambil minum kopi dikedai kopi yang ada didepannya. Banyak orang yang sedang berjalan tidak mengindahkannya, tetapi tidak sedikit juga yang menyempatkan mencuri mata, melirik pasangan anak muda itu yang terus berciuman dengan mesranya.

Dalam hati saya, dua anak muda itu, berdosa. Mereka sedang berjinah!!!. Walau saya menikmatinya, sempat juga saya baca istigfar!.

Tetapi lantas, dalam waktu yang sama, saya teringat, ada saudara-saudara kita, sedang saling bunuh membunuh. Menghancurkan kota dan kehidupan serta menewaskan ratusan orang yang tak berdosa itu.

Dalam hati saya, orang Palestina itu sedang berjihad !?

Saya ingin bertanya kepada Tuhan. Wahai Tuhan, apakah engkau akan memasukan kedua anak muda yang sedang kasih mengasihasi dan memadu cinta itu, kedalam neraka mu, karena dia sedang berjinah? Atau

Wahai Tuhan, apakah engkau akan memasukan mereka yang sedang bunuh membunuh itu, karena sedang berjihad, kedalam syurgamu?
